1. Acceptance of terms
These Terms of Service (“Terms”) govern your use of the KeyHomeGA.com website (the “Site”) and any services, including our SMS messaging program, offered through the Site. By accessing or using the Site, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Description of services
Key Home Georgia provides real‑estate brokerage and consulting services, including residential sales, leasing services, property management, investor services and consulting. The Site offers information about our services and allows users to submit contact forms to request a consultation. The information on the Site is for general informational purposes only and does not constitute legal or financial advice. Transactions involving real property can be complex; you should consult appropriate professionals before making decisions based on our content.
3. Eligibility and user obligations
By using the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. You agree to (a) provide accurate and complete information when submitting forms or inquiries; (b) use the Site only for lawful purposes and not disrupt its operation; (c) respect our intellectual‑property rights and those of third parties; and (d) comply with all applicable laws and regulations.
4. Intellectual property
All content on the Site—including text, images, graphics, logos, trademarks, audio, video and software—is owned or licensed by Key Home Georgia. You may view, download or print content for personal, non‑commercial use, provided you do not modify or remove proprietary notices. Unauthorized use, reproduction or distribution of our content is prohibited.
5. User content
If you submit reviews, testimonials or other user‑generated content, you grant Key Home Georgia a non‑exclusive, worldwide, royalty‑free license to use, reproduce and display that content in connection with our business. You represent that you have the right to submit such content and that it does not violate any third‑party rights. We reserve the right (but have no obligation) to monitor, edit or remove user content at our discretion.

This includes damages for loss of profits, data, goodwill, business interruption, personal injury or property damage. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.
9. Indemnification
You agree to indemnify and hold harmless Key Home Georgia and its officers, directors, employees and agents from any claims, damages, liabilities or expenses (including attorneys’ fees) arising from your use of the Site, your violation of these Terms or any applicable law, or your infringement of any rights.
10. Governing law and dispute resolution
These Terms and any dispute arising from them shall be governed by the laws of the State of Georgia without regard to conflict‑of‑law principles. You agree that any legal action shall be brought exclusively in a state or federal court located in Fulton County, Georgia, and you consent to the jurisdiction of those courts.
11. SMS program terms
This section applies specifically to our SMS messaging program. Industry guidelines require disclosures about message frequency, cost, opt‑out instructions and other terms. By opting in to receive text messages from Key Home Georgia, you agree to the following:
Program name: Key Home Georgia SMS Messaging.
Program description (use cases): Messages may include service‑related texts (appointment confirmations, updates on your real‑estate inquiries and transaction notices) and promotional messages (market insights, special offers or educational content). Promotional messages will only be sent if you have separately consented.
Message frequency: Message frequency varies; you may receive up to 4 promotional messages per month. Service‑related messages are sent as needed.
Message and data rates: Standard message and data rates may apply to each SMS message. Consult your wireless carrier for details.
Opt‑out: You may opt out at any time by replying STOP to any text message. After opting out, you will receive a confirmation message and will no longer receive text messages from us. You can also email us to request removal.

Carrier liability disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
Eligibility (age restriction): You must be 18 years of age or older and the authorized user of the mobile device and number provided to participate.
Privacy link: Your participation is also subject to our Privacy Policy. Your mobile number and SMS consent data will not be shared with third parties for marketing purposes.
12. Changes to terms
We may modify these Terms (including the SMS program terms) at any time. If material changes are made, we will post the updated Terms on the Site with a revised “Last Updated” date. Your continued use of the Site or participation in the SMS program after changes constitutes acceptance of the updated terms.
13. Termination
We may suspend or terminate your access to the Site or SMS program at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, your right to use the Site ceases immediately. Sections addressing intellectual property, warranties, limitations of liability, indemnification and governing law will survive termination.

It now includes explicit SMS consent terms (opt‑in requirements, message frequency, message types, cost disclosures, and opt‑out instructions) as recommended by CTIA/TCPA guidelines and clarifies that consent is not a condition of purchase. The policy also adds a mobile information sharing statement—affirming that mobile numbers and SMS opt‑in data are not shared with third parties—as well as sections on cookies, data security, retention, user rights, children’s privacy, international transfers and how to exercise your privacy rights.
The revised terms of service retain the existing structure but incorporate a detailed SMS program section, addressing program description, message frequency, carrier rate disclosures, opt‑out and help instructions, eligibility (18+), carrier liability disclaimer, and a link back to the privacy policy. It adds a reminder that participants must be authorized users of the mobile number and repeats that mobile data is never shared for marketing purposes. The terms also clarify that the user must be at least 18 years old to use the site and participate in the SMS program.
